These terms cover buying your equipment from us: prices, payment, delivery, rebates, cancellations and warranties.
1. About these terms
These terms apply when you buy equipment (such as solar panels, inverters and batteries) from Advanced All Energy Pty Ltd (ABN 51 633 806 818), trading as Solar Wholesale ("we", "us", "our"), through solarwholesale.com.au. You accept them when you accept an electrician's quote on the site and tick the box agreeing to these terms.
The installation of your system is a separate contract between you and the electrician whose quote you accept (see section 6). Our Terms of Use and Privacy Policy also apply.
2. Prices and pricing errors
- Prices are in Australian dollars and include GST.
- The price you pay us is the price of the equipment less the rebate discount: the value of the small-scale technology certificates (STCs) and any state rebate we have applied for your system (see section 8).
- Prices shown on the site are live and may change until you submit your job for quotes. Once you submit, your equipment price (less the rebate discount) is held for 72 hours. Because of demand and supplier price changes, if you accept a quote after that time we may update the price to current pricing before we issue your invoice, and we will tell you the new price before you pay. Once issued, the invoice price is fixed.
- If a price is obviously wrong because of an error, we may cancel your order and refund in full anything you have paid.
3. Payment
- When you accept a quote, we email you a tax invoice for the equipment, less the rebate discount.
- You must pay the invoice in full before delivery, by the due date shown on it. Card payments are processed securely by Stripe.
- We order your equipment only after we receive full payment.
4. Ordering and timing
Once you have paid in full, we order your equipment from our suppliers and have it delivered to our warehouse, ready for your electrician. The main factor in timing is usually the electrician's installation date, which you arrange with them. We will tell you if there is a delay in supplying your equipment.
If an item becomes unavailable, we may offer you an equivalent or better item at no extra cost. If you do not accept it, we will refund the amount you paid for that item.
5. Delivery, ownership and risk
- Your electrician is responsible for collecting the equipment from our warehouse and delivering it to your property for installation.
- Ownership of the equipment passes to you once you have paid for it in full.
- Risk in the equipment passes when your electrician collects it from our warehouse. From then on, the electrician is responsible for the equipment until it is installed, under your contract with them, and we are not responsible for loss of or damage to it.
6. Installation and paying your electrician
- Installation is carried out by the independent licensed electrician whose quote you accept, under a contract directly between you and them, on the terms of their quote.
- You pay the electrician directly, on completion of the job, for the amount in their quote plus any variations you agree with them.
- The electrician provides the warranty on their installation work (workmanship warranty).
- We are not responsible for the electrician's work, advice or delays, or for extra work needed at your property, which you arrange and agree with the electrician.
7. If your electrician can't do the job
If your chosen electrician cannot complete the installation, including because the site needs work they are not able to carry out, we will try to arrange another electrician from our network, and your equipment purchase continues. If we cannot find a replacement electrician, we will refund the amount you paid us for the equipment in full, with no restocking fee, once any equipment already collected has been returned.
8. Rebates, STCs and paperwork
- You agree to assign the STCs created for your system to PGK Distributors Pty Ltd ATF PGK Distributors Unit Trust, in exchange for the rebate discount applied to your price.
- If your system includes a battery, you confirm that you have not previously received the federal battery rebate (the Cheaper Home Batteries Program), so you are eligible for it for this system. The battery rebate can only be received once, so you are responsible for choosing a battery size that suits your future needs.
- You must sign and return, in full, all STC assignment forms and other rebate paperwork, and give us and your electrician any information needed, when asked. Rebates also depend on the system and installation meeting the rules of the relevant government program, such as installation by an accredited installer.
- If the STCs or a rebate are not created or approved, for example because your installation does not qualify or the paperwork is not provided because you have not signed it in full, you must pay us the rebate discount amount when we invoice you for it.
- If that amount is more than 30 days overdue, you must also pay interest on it, for each day after the 30 days until it is paid, at the penalty interest rate fixed under the Penalty Interest Rates Act 1983 (Vic).
9. Cancellations and refunds
- You can cancel at no cost before you pay your invoice.
- If you cancel after paying but before your electrician has collected the equipment, we will refund the amount you paid, less a restocking fee of 5% of the equipment price.
- Once the equipment has been collected by your electrician, you cannot cancel for a change of mind.
- This does not affect your rights under the Australian Consumer Law (see section 10).
10. Warranties
- Product warranties are provided by the manufacturer. Warranty claims for equipment are made directly with the manufacturer. We provide the manufacturer's warranty contact details on installation, and each manufacturer's warranty document is available on our brand pages. We do not provide assistance with product warranty claims.
- Installation warranties are provided by your electrician. Workmanship claims are made directly with the electrician.
- Our 12-month backup. If, within 12 months of installation, you cannot make a valid warranty claim because the manufacturer or the electrician no longer exists (for example, because it has stopped trading), we will take on that warranty for the rest of the 12-month period.
Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms limits those rights. To make a claim, contact us using the details in section 14.
11. Liability
Subject to your rights under the Australian Consumer Law, and to the extent permitted by law:
- we are not liable for the installation work, advice, acts or omissions of your electrician;
- we are not liable for indirect or consequential loss, including loss of energy savings, feed-in credits or other income, or changes to rebates, tariffs or government programs;
- our total liability to you in connection with your purchase is limited to the amount you paid us for the equipment.
12. Your responsibilities
- Give us and your electrician accurate information about your property, switchboard, power supply and any existing solar or inverter.
- Give your electrician safe access to your property, and cooperate with any approvals needed to connect your system to the grid.
- Complete the STC and rebate paperwork as set out in section 8.
13. Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
